1. Introduction and Definitions

• Store: The Elegance online store available at shopcomx.com.
• User: Any person who visits or uses the store.
• Customer: A person who completes a purchase through the store.
• Products: Products offered for sale through Elegance.
• Authorized supplier: Currently refers to Tuscany Leather in relation to products offered in the store.

2. Eligibility to Use the Store

By completing an order, the customer confirms having the legal capacity required to contract and purchase, and that information supplied to the store, including name, mobile number, delivery address, and contact information, is accurate and complete.

The customer is responsible for correcting inaccurate or incomplete information as soon as possible and, where possible, before the order is shipped.

3. Products and Prices

We aim to present product images, information, and descriptions as accurately as reasonably possible. Minor color differences may occur because of screen settings, lighting, and photography.

Because genuine leather is a natural material, minor natural variations in color shade, grain, texture, or natural markings may occur between pieces. Such natural variations alone are not manufacturing defects.

• Orders depend on actual product availability with the authorized supplier, and limited timing differences may occur between store inventory updates and the supplier’s actual inventory.
• If a product becomes unavailable after an order is completed, the customer will be informed and the affected product or order will be cancelled, with the amount collected for it refunded to the original payment method where supported.
• Product prices are displayed in Saudi riyals, and the amount payable to Elegance for the products is shown before order completion.
• Elegance may change displayed prices before an order is completed. Later price changes do not affect a completed order, except where an obvious technical or material error is handled in accordance with applicable regulations.
• Elegance provides free international shipping from Italy to Saudi Arabia.
• Amounts collected by Elegance do not include customs duties, import taxes, customs clearance, or processing charges that may become due when the shipment enters Saudi Arabia under DAP (Delivered at Place) terms. Such charges are borne by the recipient when due, as described in the Shipping and Delivery Policy.

4. Orders and Payment

• An order is recorded when the customer completes the purchase steps and submits the order through the store.
• An incomplete payment does not create an obligation to fulfill the order until successful payment is confirmed by the recorded order status.
• The store provides the electronic payment methods available at checkout, such as Mada, Visa, Apple Pay, and other methods available at the time of purchase.
• In exceptional cases, Elegance may need to cancel an order, including actual product unavailability, an obvious technical or material error in price or product information, a legal restriction, or a legitimate suspicion of an unauthorized payment.
• If Elegance cancels a paid order, the customer will be informed and the amount collected for the cancelled order will be refunded to the original payment method where supported.

5. Shipping and Delivery

All shipping and delivery are governed by the Shipping and Delivery Policy published in the store, which forms an integral part of these Terms.

Current Elegance products are shipped directly from Italy to the delivery address recorded in the order within Saudi Arabia, and international shipping is free.

Orders usually arrive within 5–10 business days from the date of shipment. The timeframe may be affected by the delivery city, carrier speed, customs clearance procedures, and operational conditions.

Shipping is under DAP (Delivered at Place) terms. Customs duties, import taxes, customs clearance, or processing charges may become due upon import and are borne by the recipient when due. These amounts are not additional shipping fees imposed by Elegance.

The Shipping and Delivery Policy contains further details on tracking, delays, failed delivery, responsibility for shipping information, and circumstances beyond reasonable control.

6. Returns

Returns and handling of defective or non-conforming products are governed by the Return Policy published by Elegance, which forms an integral part of these Terms, without prejudice to statutory consumer rights.

For eligible change-of-mind cases, a customer may request a return within the period stated in the Return Policy. If a different color or model is desired, the eligible product is returned under the policy and a new order is placed instead of a direct exchange.

7. Warranty and Manufacturing Defects

Tuscany Leather products are covered by the manufacturer’s 24-month warranty against manufacturing defects, subject to the manufacturer’s applicable warranty terms.

The manufacturing-defect warranty does not cover damage caused by misuse, accidents, improper storage, exposure to water or chemicals, or normal wear and tear, unless caused by a manufacturing defect.

If a manufacturing defect is suspected, the customer should contact Elegance. The case will be assessed and handled in coordination with the authorized supplier, without prejudice to the customer’s statutory rights.

8. Intellectual Property

Intellectual property rights relating to content, trademarks, logos, images, text, and designs displayed in the store belong to their respective owners or are used by Elegance under lawful rights, licenses, or permissions.

Protected content may not be copied, republished, or commercially exploited without the required permission from the rights holder, subject to applicable law.

9. Limitation of Liability

• The store is not responsible for damage directly resulting from customer misuse of a product or failure to follow appropriate care and use instructions.
• Website services or shipping operations may be affected by circumstances beyond the store’s reasonable control, such as widespread technical failures, weather conditions, customs procedures, government decisions, or force majeure. Such cases are handled under the published policies and applicable regulations.
• The store does not guarantee that the website will always be uninterrupted or free of technical errors, but will make reasonable efforts to address issues within its control.

Nothing in these Terms excludes or limits any customer right or store liability that cannot lawfully be excluded or limited under the laws and regulations of Saudi Arabia.

10. Circumstances Beyond Control and Force Majeure

Some obligations may be delayed or affected by events beyond the store’s reasonable control, including natural disasters, severe weather, disruptions in transportation or shipping services, government actions or decisions, customs restrictions, widespread technical disruptions, and other exceptional circumstances.

In such cases, the store handles the order according to the actual circumstances and applicable regulations and aims to inform the customer of material developments when relevant information is available, while preserving the customer’s statutory rights.

11. Changes to These Terms

Elegance may update or amend these Terms when necessary to reflect applicable regulations or operational requirements.

Changes apply to use of the store and new orders from the date the updated version is published. They do not apply retroactively in a way that reduces rights connected with orders completed before the change.

12. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws and regulations of Saudi Arabia.

If a disagreement or dispute arises, we first aim to resolve it amicably with the customer without affecting the customer’s right to approach the competent authorities. If an amicable resolution is not reached, jurisdiction lies with the competent judicial authorities in Saudi Arabia in accordance with applicable law.
